To use DigiKendr, you must:

• Be at least 13 years old (or the legal minimum age in your region).
• If under 18, have permission and supervision from a parent/legal guardian.
• Be fully able and legally competent to accept these Terms.
• Not be barred from using our services under local laws or regulations.

2. Description of Services

DigiKendr provides AI-powered marketing and business automation tools, including:

• Campaign Navigator: AI for ad strategy, budget distributions, audiences, and optimization.
• Conversion Architect: Landing page & funnel optimization AI.
• Retention Maestro: AI for customer retention, CRM flows, and lifecycle management.
• Analytical Analyst: AI for analytics, forecasts, and revenue insights.
• DigiKendr API: APIs allowing secure access to AI functionalities.

We may add, modify, or remove features at any time.

3. User Accounts

You may need a DigiKendr account to access certain features or APIs.

You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Not share your account access
• Immediately notify us of unauthorized access

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. API Usage & Restrictions

When using DigiKendr APIs—including the Campaign Navigator API—you agree:

4.1. Acceptable Use

You may use the API to:

• Build automations or integrations for your own business
• Retrieve insights, analytics, recommendations
• Execute API requests within defined rate limits
• Use API responses in your product/service according to these Terms

4.2. Prohibited Use

You may not:

• Reverse engineer, extract, or replicate the AI models
• Resell, redistribute, or sublicense the API
• Use the API for illegal, harmful, or malicious activities
• Exceed rate limits or circumvent usage caps
• Attempt to access restricted endpoints or internal systems
• Transmit malware, harmful code, or scrapers

4.3. Rate Limits

We provide reasonable usage limits. Excessive load or abuse may result in throttling or suspension.

4.4. Termination

We may revoke or suspend API access if you violate terms or engage in abuse.

5. Subscription, Payments & Refunds

DigiKendr offers a variety of subscription tiers (Free Trial, Starter, Pro, Scale, Enterprise).

5.1. Billing

• Subscriptions auto-renew unless cancelled.
• Charges are made upfront for the billing cycle.

5.2. Refunds

Refunds are not guaranteed, but may be issued in exceptional cases.

5.3. Price Changes

We may modify pricing with prior notice.

6. User Content & Data

You may upload input for AI processing (images, videos, URLs, text, etc.).

You retain ownership of your content but grant us a license to:

• Process the content
• Generate results
• Improve service reliability
• Detect abuse or security threats

We do not sell your data.

7. Intellectual Property

All DigiKendr trademarks, UI, code, algorithms, AI models, and dashboards are property of DigiKendr.

You may not copy, replicate, or distribute:

• Designs
• AI logic
• API infrastructure
• Brand assets
• Source code

8. Limitation of Liability

To the maximum extent permitted by law:

• DigiKendr is not liable for indirect, incidental, or consequential damages.
• AI outputs may not always be accurate, complete, or reliable.
• You are responsible for verifying AI suggestions before using them.
• We are not responsible for losses caused by ad platforms, APIs, suspensions, or bans.

9. Warranties Disclaimer

DigiKendr services are provided "as-is", without warranties of any kind.

We do not guarantee:

• Results from using AI
• Ad performance
• Technical uptime
• Accuracy of AI-generated insights

10. Termination of Services

We may suspend or terminate your account for:

• Violating Terms
• Misusing the API
• Causing harm or instability
• Attempting to hack or attack systems

You may delete your account at any time.

11. Governing Law

These Terms are governed by the laws of India, regardless of conflict-of-law principles.

12. Changes to Terms

We may update these Terms at any time. Continued use means acceptance of updated Terms.
